Sidewalk Maintenance Ordinance

BE IT ORDAINED BY THE CITY OF ASHLAND, KENTUCKY:

                        SECTION 1.  That the owners or occupiers of lots shall keep the sidewalks in front thereof clear, in good repair and free from mud, dirt, snow, ice, weeds, or other obstructions; and if any person fails or refuses to clear the sidewalks for forty-eight (48) hours or repair said sidewalks within ninety (90) days after being notified so to do by the Director of Public Works or City Engineer, it shall be the duty of the City of Ashland to have the work done at the expense of the City; and when so done the City shall have a lien upon the abutting property to secure it for the expense of said work, together with interest and costs.

                        SECTION 2.  Any person who violates any provision of this ordinance shall be punished by a fine not exceeding Two Hundred and Fifty Dollars ($250.00) nor more than the limits set forth in Kentucky Revised Statutes 534.040.  Every day any violation shall continue shall constitute a separate offense.

                        SECTION 3.  That R.O. 1939 §1547 is hereby repealed.  All other ordinances and parts of ordinances in conflict with herewith, to the extent of such conflict only, are hereby repealed.

                        SECTION 4.  This ordinance shall be in full force and effect from and after its adoption, readoption and publication, as required by law.
